Do I have to wait for the criminal case to finish?
No. Your injury claim is separate from the criminal DUI case. They can move at the same time, though one may affect the other. We coordinate.
The driver was never convicted. Can I still bring a claim?
Yes. A civil claim uses a lower standard of proof than a criminal case. Evidence like blood alcohol results, officer observations and witness statements can still be used.
The drunk driver had little or no insurance. What now?
Your own uninsured/underinsured motorist (UM) coverage may help, along with other responsible parties. We look at every policy.
How long do I have?
In Georgia, generally two years for personal injury. When there’s a related criminal case, the deadline may be paused for a time, but don’t count on it.
